RE: Attendance Arbitration
Yesterday, we began the attendance arbitration for all five Association Agreements. The case is being presented for the Association by Christina Gornail, from the law firm of Richard, Phillips, & Rind P.C. We initially prepared to complete the case in the one day made available by the Arbitrator. Due to the number of witnesses on both sides, we will be proceeding with additional days scheduled by the Arbitrator on December 14 & 15.
On day 1, both sides presented opening statements, and the Association presented our first 3 witnesses. So far, our witnesses have presented the history of Article 24 and the impact of this unreasonable policy on our members.
At the conclusion of our case, which we expect to conclude on the morning of the 14th, the Company will begin presenting their case. Then the Association will have an opportunity for rebuttal, if necessary.
Yesterday went exactly as we expected, including the arguments the Company made in its opening statement. This is an important case for our members, and we look forward to continuing to fight the Company’s violations of our contracts in December.
